Assured Training – Terms and Conditions

These Terms and Conditions ("Terms") govern the provision of training services by Yorkshire Primary & Community Care Services (YPCHealth) Ltd, trading as Assured Training, registered office at 1 Skipton Road, Ilkley, LS29 9EH, UK. By booking or participating in any course, you agree to be bound by these Terms. Assured Training is a Qualsafe Awards-approved centre (Centre No. 0907866), offering both regulated and non-regulated first aid and health & safety training.

1. Bookings and Eligibility

1.1 Course Booking:

  • Individual and open course bookings must be paid in full at the time of booking unless agreed otherwise.

  • Business clients may book via email, phone, or purchase order and will be invoiced unless pre-payment is requested.

  • A booking is confirmed only once payment or an approved purchase order is received.

1.2 Age Requirements:

  • Courses are generally suitable for delegates aged 18+. Delegates under 18 may attend with prior agreement and written parental consent, provided they are accompanied by a responsible adult.

1.3 Course Suitability:

  • It is your responsibility to ensure the chosen course meets your needs or those of your delegates.

  • Attendees must meet any course prerequisites (e.g. English proficiency, physical fitness). If a delegate is unable to participate safely or does not meet the requirements, they may be refused admission without refund.

1.4 Delegate Substitutions:

  • You may substitute delegates up to one day before the course, provided the replacement meets all criteria.

1.5 Special Requirements:

  • We are committed to equal access. Please inform us at booking if you have a disability or medical condition requiring adjustments. We will make reasonable adjustments where possible.

  • Note: Certain physical competencies (e.g. CPR on a manikin) are required for certification. If a delegate is unable to perform essential practical skills, certification may not be possible.

1.6 Language Requirements:

  • All courses are delivered in English. Delegates should have sufficient English to understand and participate safely. We recommend Level 2 proficiency.

2. Payment and Pricing

2.1 Prices and VAT:

  • Prices are exclusive of VAT unless otherwise stated. VAT will be applied at the prevailing rate.

2.2 Payment Terms:

  • Individual bookings: payment due in full at booking.

  • Business/invoice bookings: payment due within 30 days of invoice date or prior to course delivery, whichever is sooner.

2.3 Late Payments:

  • For business customers, we reserve the right to charge interest on overdue invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 (8% over base rate), plus recovery costs.

2.4 Certificates:

  • Certificates are issued upon successful completion and full payment. Delays in payment may delay certificate release.

3. Cancellations and Refunds

3.1 Cooling-Off Period (Consumer Bookings):

  • If you book as a consumer online or by phone, you have a 14-day right to cancel for a full refund unless the course starts within this period and you have agreed to waive the right.

3.2 Cancellation by Customer:

  • 14+ days before course: full refund or free transfer.

  • 8–13 days: 75% refund or reschedule with 25% admin fee.

  • 0–7 days: no refund. Rescheduling only at our discretion and may incur fees.

3.3 Non-Attendance:

  • No refund for no-shows. In genuine cases (e.g. medical emergency), we may offer rescheduling upon proof, at our discretion.

3.4 On-Site Bookings:

  • May be rescheduled once with 14+ days’ notice.

  • 8–13 days: 25% fee.

  • 0–7 days: 50–100% fee retained.

3.5 Cancellation by Assured Training:

  • We may cancel or reschedule due to insufficient numbers or unforeseen circumstances. A full refund or transfer will be offered. We are not liable for incidental costs (e.g. travel, hotel).

4. Attendance and Assessment

4.1 Attendance:

  • Full attendance is mandatory. Late arrival or early departure may result in non-certification.

4.2 Assessments:

  • Regulated courses include formal practical and written assessments.

  • Certification is only granted to delegates who demonstrate competence.

4.3 No Pass, No Fee Policy:

  • Fees are for training delivered. No refund is given if a delegate fails to meet assessment criteria.

4.4 Appeals:

  • You may appeal assessment results via our internal process. Unresolved appeals may be taken to Qualsafe Awards.

5. E-Learning and Blended Training

5.1 Access and Licensing:

  • E-learning content is for the named learner’s use only and must not be shared. Access is time-limited (typically 90 days).

5.2 Technical Requirements:

  • Learners are responsible for ensuring their device and internet connection meet course requirements.

5.3 International Access:

  • Courses are based on UK standards. We do not guarantee recognition abroad. International learners are responsible for confirming local acceptance.

5.4 Cancellations for E-Learning:

  • If you start accessing content, you may forfeit your 14-day right to cancel under consumer law.

6. Behaviour and Safety

6.1 Code of Conduct:

  • Disruptive, abusive, or unsafe behaviour will result in removal without refund.

  • Delegates must follow trainer instructions and health & safety rules.

6.2 Venue Requirements (On-Site):

  • Clients must provide a safe, clean, and suitable space for training. If the venue is deemed unsuitable, we may cancel and charge the full fee.

7. Liability and Indemnity

7.1 Limitation of Liability:

  • We are not liable for indirect or consequential losses.

  • Our liability is limited to the course fee paid.

  • Nothing in these Terms excludes liability for death or injury caused by our negligence.

7.2 Indemnity (Business Clients):

  • Clients agree to indemnify us against claims arising from unsafe conditions at client-controlled venues, except where caused by our negligence.

7.3 Application of Training:

  • We teach skills to current guidelines but are not responsible for how attendees apply them post-course.

8. Data Protection

8.1 GDPR Compliance:

  • We handle data in accordance with the UK GDPR and Data Protection Act 2018.

  • Personal data is used for course administration, certification, and customer service.

  • We share information only with trusted providers (e.g. Qualsafe Awards) or as legally required.

8.2 Marketing:

  • We may send you relevant training updates. You can opt out at any time.

9. Intellectual Property

Course content, materials, and e-learning modules are the intellectual property of Assured Training or our licensors. You may not copy, reproduce, or distribute them without permission.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of English courts.
